Please read these Terms and Conditions (“Terms”) carefully before using the Steamboat Springs Winter Sports Club website located at sswsc.org (the “Site”), operated by Steamboat Springs Winter Sports Club (“SSWSC”, “we”, “us”, or “our”).

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please discontinue use of the Site immediately.

Acceptance of Terms

These Terms apply to all visitors, users, and others who access or use the Site. Your continued use of the Site following any updates to these Terms constitutes acceptance of those changes. We reserve the right to modify these Terms at any time, and will indicate the date of the most recent update above.

Use of the Site

Permitted Use

The Site is provided for informational purposes related to SSWSC’s programs, events, admissions, and community. You may use the Site for lawful, personal, non-commercial purposes consistent with these Terms.

Prohibited Use

You agree not to:

  • Use the Site in any way that violates applicable federal, state, or local law or regulation
  • Scrape, harvest, or collect data from the Site using automated tools without prior written permission
  • Attempt to gain unauthorized access to any portion of the Site or its related systems
  • Transmit any unsolicited or unauthorized advertising, spam, or promotional materials
  • Impersonate SSWSC, its staff, athletes, or any other person or entity
  • Interfere with or disrupt the integrity or performance of the Site
  • Upload or transmit viruses, malicious code, or any content that is harmful, offensive, or unlawful

Intellectual Property

All content on the Site — including but not limited to text, images, video, graphics, logos, program names, and the overall design — is the property of Steamboat Springs Winter Sports Club or its content licensors and is protected by applicable U.S. and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the Site without the prior written consent of SSWSC. Limited personal, non-commercial use (such as sharing a link or printing a page for personal reference) is permitted provided no copyright or attribution notices are removed.

The SSWSC name, logo, and all related marks are trademarks of Steamboat Springs Winter Sports Club. Nothing in these Terms grants you any right to use SSWSC’s trademarks without express written permission.

 User-Submitted Information

The Site includes forms through which you may submit information, including athlete inquiries, contact requests, and newsletter signups. By submitting information through the Site, you represent that the information is accurate and that you have the authority to provide it.

We do not claim ownership over information you submit, but you grant SSWSC a non-exclusive, royalty-free right to use submitted information for the purpose for which it was provided (e.g., responding to an inquiry, sending newsletters). Please see our Privacy Policy for details on how we handle personal data.

The Site is not intended to receive sensitive personal information beyond what is necessary for the stated purpose of each form. Do not submit financial account information, government ID numbers, or other sensitive data through Site forms.

Third-Party Links and Platforms

The Site contains links to third-party websites and platforms, including but not limited to:

  • CampMinder — used for athlete registration and returning athlete login
  • Neon One — used for processing charitable donations
  • Constant Contact — used for email newsletter management
  • Partner websites, including Steamboat Ski Resort, Howelsen Hill Ski Area, Steamboat Mountain School, and others

These links are provided for convenience only. SSWSC does not control, endorse, or assume responsibility for the content, privacy practices, or terms of any third-party site. We encourage you to review the terms and privacy policies of any third-party platform you access through the Site.

Your use of third-party platforms, including any enrollment, donation, or registration transactions conducted through those platforms, is governed solely by the terms of those platforms.

Program and Enrollment Disclaimer

Information on the Site describing SSWSC programs, schedules, fees, coaches, policies and facilities is provided for general informational purposes and is subject to change without notice. The Site does not constitute an offer of enrollment or a binding agreement regarding program terms.

Enrollment in SSWSC programs is governed by separate enrollment agreements, liability waivers, and policies provided to athletes and families during the admissions process. In the event of any conflict between information on the Site and the terms of a signed enrollment agreement, the enrollment agreement controls.

Donations

Donation functionality linked from the Site is hosted and processed by Neon One, an independent third-party platform. SSWSC does not collect or store payment information through the Site. All donations are subject to Neon One’s terms of service and refund policies.

SSWSC is a registered 501(c)(3) nonprofit organization. Donors should consult their tax advisor regarding the deductibility of charitable contributions.

Disclaimers

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

SSWSC does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or timeliness of any content on the Site. Program information, dates, fees, and staff listings may change, and we encourage you to contact us directly to confirm current details.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SSWSC, ITS BOARD OF DIRECTORS, OFFICERS, EMPLOYEES, COACHES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall SSWSC’s total liability to you for any claims arising from your use of the Site exceed one hundred dollars ($100.00). This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless SSWSC and its officers, directors, employees, coaches, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any rights of a third party. 

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Routt County, Colorado, and you consent to personal jurisdiction in those courts.

 Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the Site with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. If you have questions about any changes, please contact us.

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
